ACB STATEMENT ON JUNK FAX PREVENTION ACT
Statement by Michael W. Briggs, chief legal officer, America’s Community Bankers, on passage today by the House of a bill to allow businesses to send faxes to recipients with whom they have an existing business relationship:
Congress took the final step today to avoid what would have been an unnecessary restriction on businesses communicating with their customers. We anticipate that President Bush to sign into law the Junk Fax Prevention Act prior to July 1, which will ensure that the Federal Communications Commission’s flawed regulations do not impede the flow of important information.
The bill permanently maintains in statute an exception allowing businesses to send unsolicited faxes to persons with whom they have an “established business relationship.” This common-sense solution is particularly important to community banks whose mortgage lending would have been seriously impeded by having to receive written consent from customers before sending a fax. The bill provides consumers with the important benefit of an opt-out mechanism.
